LOS ANGELES (AP) — Another patient has sued the maker of a medical scope linked to a deadly “superbug” outbreak at Ronald Regan UCLA Medical Center.

It’s the third lawsuit against Olympus Corp. of the Americas, which makes a hard-to-clean specialized endoscope involved in the UCLA outbreak of the antibiotic-resistant bacteria known as CRE. Seven patients were infected, including two who died.

Domingo Gomez filed the latest legal action Monday in Los Angeles Superior Court. The lawsuit alleges products liability, negligence and fraud. It says Gomez experienced “extraordinary pain and suffering.”

Olympus has said it doesn’t comment on lawsuits.

Federal regulators have said the company didn’t seek FDA clearance for the latest version of its scope. They’re asking manufacturers to show the scopes can be safely disinfected.
